5If a loved one becomes mentally incapacitated and unable to manage their medical and financial affairs, a caring individual often steps up to assist. To take over the affairs of the individual, there needs to be a court order allowing someone to supplant that person’s legal rights to act on his/her own behalf.
Unfortunately, family members often cannot agree on the preferred individual to assume the role, so these sorts of court appointments can become contentious. Also, two medical experts are required to opine that the individual is mentally incapacitated before the court will allow the appointment of the committee.
